In opposing a new trial for the Menendez brothers in their parents' killing, L.A. County Dist. Atty. Nathan Hochman cited an issue that has dogged the defendants.

The Menendez brothers are serving sentences of life in prison without parole. Last October, amid a flurry of renewed attention to the high-profile case, D.A. George Gascón said he would ask a court to lower their sentences to 50 years to life, which would make them eligible for parole.

The district attorney of Los Angeles says he will update the public Friday on a new sentencing hearing for celebrity brothers Lyle and Erik Menendez.
